Welcome to PienaarBank, a division of Pienaar Group Executive (Pty) Ltd (“we,” “our,” or “us”).
By accessing or using our website, online banking system, or any of our services, you agree to be bound by these Terms of Service (“Terms”).

• Client / User / Borrower — any person or entity using our platform or applying for our financial products or services.

• Platform — refers to our website, mobile applications, and any associated systems under pienaargroupexecutive.com.

• Services — all financial products, loans, digital banking tools, and related administrative support provided by PienaarBank.

• Agreement — the binding contract formed between the Client and PienaarBank once a loan or account is approved.

2. Acceptance of Terms

By creating an account, submitting an application, or using our services, you:

• Confirm that you are 18 years or older and legally competent to enter into financial agreements.

• Authorise PienaarBank to verify your identity, credit history, and any information provided.

• Agree that electronic acceptance, including checkbox or digital signature, constitutes a valid and enforceable contract.

3. Our Services

PienaarBank provides access to financial products including:

• Personal, business, and asset-based loans

• Fixed deposit and savings services

• Digital account management

• Customer support and advisory services

All products are subject to individual approval, credit assessment, and compliance with the National Credit Act (NCA) and Financial Intelligence Centre Act (FICA).

4. Account Registration

To access our services, users must:

• Provide accurate and up-to-date personal information.

• Maintain the confidentiality of login credentials.

• Promptly notify us of any unauthorised access or security breach.

PienaarBank reserves the right to suspend or terminate accounts that contain false, incomplete, or misleading information.

5. Loan Applications and Agreements

All loan applications undergo a creditworthiness assessment.
By submitting an application, you consent to:

• Credit checks with registered credit bureaus.

• Verification of income and employment.

• Contact from our verification and compliance departments.

Upon approval, you will receive a Loan Agreement detailing the loan amount, repayment schedule, interest rate, and applicable fees.
No funds will be disbursed without acceptance of this agreement.

6. Fees and Charges

All applicable charges are disclosed upfront in your loan offer.
Typical fees may include:

• Origination fees

• Monthly service or administration fees

• Late payment penalties

• Legal and collection costs (in case of default)

We comply fully with the National Credit Regulator (NCR) fee caps and disclosure requirements.

7. Repayments and Defaults

• Repayments are due on the schedule provided in your loan agreement.

• Late or missed payments may result in penalty fees and credit reporting.

• Persistent non-payment may result in legal recovery action, including transfer to a registered debt collector or attorney.

• You remain liable for all outstanding principal, interest, and reasonable collection costs.

8. Interest Rates

Interest rates are determined based on credit profile, loan type, and prevailing market conditions.
Rates are expressed as annual percentage rates (APR) and remain fixed or variable as stated in the agreement.

9. Privacy and Data Protection

We respect your right to privacy.
All data collected is processed in accordance with:

• The Protection of Personal Information Act (POPIA)

• The General Data Protection Regulation (GDPR) (where applicable)

Your information will only be shared with:

• Credit bureaus, payment processors, or regulatory authorities

• When required by law or authorised by you in writing

10. Communication and Notices

You consent to receive communications electronically via:

• Email, SMS, WhatsApp, or in-app notifications
  All notices are deemed received once sent to your registered contact details.
  You may opt out of promotional communications at any time.

11. Limitation of Liability

While we take all reasonable care to provide accurate information, PienaarBank shall not be liable for:

• Any indirect, incidental, or consequential losses arising from service use.

• Delays, errors, or interruptions caused by third-party systems or technical failures.

• Losses due to unauthorised account access caused by user negligence.

Nothing in these Terms limits rights under South African consumer protection law.

12. Termination of Service

We may suspend or terminate any account or service if:

• Fraud, misuse, or suspicious activity is detected.

• You fail to meet repayment obligations.

• Required legal or compliance information is withheld.

Upon termination, all outstanding balances become immediately due and payable.

13. Dispute Resolution

Any dispute arising from these Terms or our services will first be addressed through internal mediation.
If unresolved, it may be referred to:

• The National Credit Regulator (NCR), or

• The Ombudsman for Banking Services (OBS)

You may also pursue remedies through the courts of South Africa.

14. Amendments

PienaarBank reserves the right to update these Terms at any time.
Revised versions will be posted on our website, and continued use of our platform constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
All disputes shall be subject to the exclusive jurisdiction of the High Court of South Africa.
